How Much Does a Payday Loan Really Cost in Florida

What Florida law actually caps

Florida law limits a payday loan (called a "deferred presentment" loan) to $500. The fee is capped at 10% of the amount plus a $5 verification fee. The term runs 7 to 31 days. You can only have one payday loan at a time statewide, and there is a 24-hour wait before you can take another. Rollovers are not allowed. This comes from Fla. Stat. ch. 560 Part IV, as published by the Florida Office of Financial Regulation. Every lender must be licensed with that office — check before you sign.

What the $500 loan actually costs

Do the arithmetic on the maximum allowed loan: 10% of $500 is $50, plus the $5 fee, equals $55 — for a loan lasting anywhere from 7 to 31 days. That $55 is the legal maximum fee, not an estimate of what every lender charges. Ask any lender to show the fee in writing before you sign.

Florida also allows installment ("deferred presentment installment") loans up to $1,000, with their own separate fee caps. A title loan is a different product under Fla. Stat. ch. 537 — the real risk there is losing the car, not just the fee.

Cheaper ways to borrow, in order

None of these should be a title loan, a pawn of tools you need for work, or an online "tribal" loan.

If you already have a payday loan and can't pay it back

Florida allows only one payday loan at a time, and rolling it over into a new loan is not permitted here. If you cannot repay on time, you have the right to a 60-day grace period if you complete credit counseling — this is written into Fla. Stat. 560.404(19). A credit union PAL can sometimes be used to refinance an existing payday loan at a much lower cost.

Help before any loan

Before borrowing, call 211 for utility, rent, food, and medical assistance programs in your county. A free first-session credit counselor through the NFCC can also look at your whole situation by phone, at no charge.
