🏥FMLA Eligibility & Request LetterCan you take the leave? Here's the test — and the letter.
Working families

Twelve weeks, job protected. If you pass three tests.

The FMLA is the only leave law most Florida workers have — and eligibility turns on numbers the HR email never shows you. Answer four questions. You get the three tests computed, the deadlines for notice and the medical certification, the rules on pay and insurance while you're out, and the letter that starts the clock on the employer's side. Free check

Four numbers, and the reason.

When you started, roughly how many hours you worked in the last 12 months, how many employees the company has within 75 miles of your site, and what the leave is for.

Free. Takes a few seconds.

Why this exists

'We don't do FMLA here' is not a policy. It's a violation waiting to happen.

If the three tests are met, the leave exists whether or not the supervisor likes it — and the employer has its own deadlines to designate it and ask for certification.

How it works

Three tests. Two deadlines. One letter.

Common questions

Do I qualify for FMLA leave?

FMLA Eligibility & Request Letter checks the three federal tests: 12 months with your employer, 1,250 hours worked in the last 12 months, and 50 or more employees within 75 miles. It computes these from the numbers you type in, but hours are counted by your employer's records, so ask for them. This is not legal advice.

What deadlines will the tool show me?

It gives you the notice and medical-certification timelines set out in the Family and Medical Leave Act (29 U.S.C. 2601 et seq.) and 29 CFR Part 825. These are the deadlines that apply once your written request letter starts the clock on the employer's side. The tool does not file anything for you.

Does Florida give me any extra leave beyond FMLA?

No — Florida has no state family or medical leave law for private employers, and the tool says so plainly. Some employers offer more than FMLA requires through their own policy, so it's worth checking your handbook.

Is it really free? Is what I type stored?

Yes, it's free, and it's available in English and Spanish. The material doesn't state whether what you enter is stored, so check the tool's own site for that detail before pasting anything sensitive.

What if my employer denies my leave or retaliates against me?

This tool can't handle a denial or retaliation claim — it only computes eligibility and drafts a request letter. For a denial or retaliation, the U.S. DOL Wage and Hour Division (1-866-487-9243) is free to call. It is not legal advice.
