What a "pre-existing" denial means
The warranty company's contractor looked at your broken AC and wrote that the problem existed before your contract started, or before your coverage period. That word alone is not proof. Your contract's own coverage and exclusion language, plus your evidence, decide whether the denial is correct.
Florida rules that apply
Home warranty companies in Florida are "service warranty associations." They are licensed and regulated under Fla. Stat. ch. 634 Part III, overseen by the Florida Office of Insurance Regulation. You can check whether your company is actually licensed at Florida OIR — Company search. Misleading claim handling can also fall under Florida's consumer-protection law, Fla. Stat. 501.204 (FDUTPA). None of this overrides your contract's own terms — read the coverage, exclusions, caps, service fee, and timing language first.
Evidence that often overturns a "pre-existing" denial
- The home inspection report from when you bought the house, if it did not flag the AC unit.
- Any inspection or waiver the warranty plan itself required when you signed up.
- Your claim-free history on the plan, if you have held it for years without incident.
- A second opinion from a licensed HVAC contractor, in writing.
- The technician's actual written report — request it if the denial letter only gives you a one-line summary.

Write the appeal
- Date it. Include your contract/policy number.
- Name the item and the failure date.
- Quote the denial reason word for word.
- Quote the contract's coverage language, and the exclusion language they cited — then explain, on your facts, why the exclusion does not apply.
- Attach your evidence: inspection report, service receipts, photos, second opinion.
- Ask for one of three things: approval of the repair or replacement, cash-in-lieu at the contract amount, or a written explanation citing the specific contract section.
- Give a deadline — 7 to 10 days.
- State plainly that you will file a Florida DFS complaint if it isn't resolved.
Keep it polite and specific. No insults.
If they don't respond, escalate
- Written appeal, then the claims supervisor or manager.
- A complaint to Florida's Department of Financial Services at 1-877-693-5236 — Florida DFS Consumer Services. DFS forwards it to the company, which must answer in writing.
- Better Business Bureau and the Florida Attorney General.
- Small claims court, for disputes up to $8,000, no lawyer required — see Florida Courts — Small claims. Bring the contract, the denial, and your second opinion.
If your contract's own cancellation clause allows a prorated refund, a denial is a reasonable time to decide whether to keep paying — read that clause. Do not stop paying your premium while a claim is open.
