How often do we renew our Florida sales tax exemption certificate?

Use the free tool — Nonprofit Compliance FL

What the certificate is

A Florida nonprofit that wants to buy things tax-free — supplies, equipment, materials for its exempt purpose — applies to the Florida Department of Revenue for a Consumer's Certificate of Exemption using Form DR-5. This certificate is what a vendor asks to see before waiving sales tax on your purchase.

How often you renew it

The Consumer's Certificate of Exemption is valid for five years. After that, it must be renewed with the Department of Revenue. Mark the expiration date somewhere your next treasurer will find it — a board calendar or the minutes — so the certificate doesn't quietly lapse.

Selling goods is a different question

Having an exemption certificate lets your organization buy tax-free. It does not automatically mean you're exempt from collecting sales tax when you sell things — concessions, merchandise, tickets to a fundraiser dinner, and similar sales can still require you to collect and remit sales tax. Ask the Florida Department of Revenue about your specific sales before assuming they're exempt.

Other Florida dates that often come up alongside this one

Volunteer boards juggling the sales tax certificate are usually also tracking other deadlines: whether Florida's charitable-solicitation law (Fla. Stat. ch. 496) requires registering with FDACS before fundraising, the Form 990 deadline with the IRS, and the not-for-profit annual report window at Sunbiz between January 1 and May 1. If you're planning a raffle or 50/50, that's governed separately by Fla. Stat. 849.0935.

What to do next

This is general information, not legal or tax advice, and it can be wrong — confirm your certificate status and renewal date with the Florida Department of Revenue directly. The free tool reads your own numbers: tell it your organization type, fiscal year, and how you raise money, and it calculates your FDACS, 990 and Sunbiz dates alongside a reminder about the sales tax certificate — nothing you enter is stored.
