Screening rules if seniors will work with children, other seniors or money

Florida requires Level 2 (fingerprint-based) background screening under Fla. Stat. ch. 435 for people in positions of trust with children or vulnerable adults — but only in licensed or specified settings. The Florida Department of Children and Families and the Agency for Health Care Administration run this for their licensed programs.
If your church or nonprofit program is not licensed, a background check is usually a best practice or an insurance requirement — not a legal mandate. Confirm which applies to you with DCF or your licensing agency before placing a senior volunteer around kids or vulnerable adults.
Never assume "no check needed" for a role around children — check first.

Liability: what Florida's law does and doesn't cover

Florida's Volunteer Protection Act (Fla. Stat. 768.1355), along with the federal Volunteer Protection Act of 1997, limits a volunteer's own personal liability for ordinary negligence while acting within the scope of a nonprofit's activities. It does not protect your organization, and it does not cover gross negligence or driving.

A volunteer driving their own car is covered first by their own insurance. Confirm their license and insurance, and consider non-owned auto coverage.
A volunteer driving your organization's van is only covered if your policy allows volunteer drivers. Ask your insurer before anyone drives.
