What is the max HOA fine allowed in Florida?
Use the free tool — HOA Violation Responder FL
The short answer
Florida Statutes chapter 720 caps HOA fines at $100 per violation, per day, up to a total of $1,000. That is the maximum the statute allows. Your association's own declaration and covenants also apply on top of the statute, so the real number in your case can depend on your documents too.
The 14-day notice and hearing you're owed
Before an HOA can impose a fine, Florida law requires 14 days' written notice and a hearing. That hearing has to be in front of a committee — not the board itself. If your notice skipped this, or the hearing was run by the board, that matters.
- Written notice: 14 days before any fine.
- Hearing: before a committee separate from the board.
When a fine can turn into a lien
A fine can become a lien once it passes a certain point. If your fine is over $1,000, or there's already a lien or a foreclosure threat attached to it, that's a different situation — the material here is clear that you should talk to a Florida HOA attorney at that stage, and notes that many offer flat-fee letters.
What changed in 2024
Since 2024, there's a list of things associations can't fine you for at all, on top of the existing $100/day and $1,000 caps. But the 2024 changes have exceptions — it isn't a blanket shield for every situation. This reflects Chapter 720 as it stands today, not a guarantee for your specific notice.
If you live in a condo, this is different
Condominiums are governed by Florida Statutes chapter 718, not chapter 720, and the rules differ. Everything above is about HOAs under chapter 720. If your notice came from a condo association, confirm which statute actually applies to you.
What to do next
This page can't read your specific notice. The free tool does: paste your HOA's letter, and it reads the date, the rule cited, and the fine amount against Chapter 720 as it reads today — including whether the 14-day notice and hearing were followed, whether the fine math fits the caps, and your deadline computed from the notice date. It is not legal advice. For a lien, a foreclosure threat, or a fine over $1,000, confirm with a Florida HOA attorney.
