Can a lender repossess my car without going to court in Florida?
Yes. Under Fla. Stat. 679.609, a Florida lender may repossess your car after a default without a court order. The law does not require a lawsuit first.
What the lender may not do
That same statute says the lender may not "breach the peace" while taking the car. The material we have does not list every example of what counts as a breach of the peace. If something happens during a repossession that feels forced or violent, write down what happened and contact a legal aid office.
Before the car is sold — notice and the deficiency
If the lender repossesses your car and plans to sell it, it must send you notice first, under Fla. Stat. 679.611 · 679.614. If the sale does not cover what you owe, you may still owe the difference plus costs — this is called a deficiency.

- You may owe the deficiency: the gap between the sale price and your balance, plus costs.
If you're behind, call before the due date
Call your lender before the payment is due. Ask in writing for a deferment or an extension. Do not stop paying, do not hide the car, and do not wait for it to be repossessed.
