What "deficiency" means
If your car is repossessed and sold, the sale price often does not cover what you owe. The gap between the sale price and your loan balance, plus costs, is called a deficiency. You may still owe this amount after the car is gone.
Notice before the sale
Florida law says the lender must send you notice before selling a repossessed car (Fla. Stat. 679.611 · 679.614). This notice should come before the sale, not after.
Repossession without a court order
In Florida, a lender may repossess your car after you default, without going to court first. But the lender may not breach the peace while doing it (Fla. Stat. 679.609). This is general information, not legal advice — confirm your situation with a professional.
What you may still owe
After the sale, you may owe the difference between what the car sold for and what you owed, plus any costs the lender adds. Ask the lender for a full written breakdown of the sale price, the balance before the sale, and the costs added.

If you had GAP insurance, an extended warranty, or other add-ons on the loan, these can often be cancelled for a prorated refund. Ask your lender in writing.
