Can a Roofer Take Over My Insurance Claim in Florida?
Use the free tool — Storm Contractor Contract Check FL
What is an "assignment of benefits"?
An assignment of benefits, or AOB, is a clause in a roofing or repair contract. If you sign it, you hand your right to deal with the insurance company directly to the contractor. The contractor — not you — then negotiates with your insurer, and can be paid directly from your claim.
A contractor at your door after a storm may ask you to sign this along with the repair contract, sometimes on the hood of a truck, sometimes fast.
The Florida rule on AOB
Florida law bans assignment of benefits on insurance policies issued after 2023. If your policy was issued after that date, an AOB clause in a roofing contract should not be enforceable. This is based on Florida Statute §627.7152.
This is informational, not legal advice. Whether a specific AOB clause applies to your specific policy depends on your policy's issue date and its exact wording. Confirm with a professional if you are not sure.
Other rules that protect you before you sign
- Deposit and start date (§489.126): Florida has a 10%-deposit / 90-day-start rule. A contract that asks for a much larger deposit, or that has no start date at all, does not match this rule.
- 3-day cancellation right: For door-to-door sales, Florida gives you a 3-day right to cancel.
- Licence check: A valid contractor should have a licence number you can look up. Verification is done at myfloridalicense.com — the tool cannot verify a licence for you, you must check it yourself.
- Permit and insurance certificate: A legitimate contractor should be able to show proof of insurance and pull the correct permits.
These rules are drawn from Florida Statutes 489.126, 489.127, 501.025, 627.7152, 713.015 and 817.234, as of 2025–26.
