What is Florida reemployment tax?
Florida reemployment tax (formerly called unemployment tax) is a state tax on employers. It funds unemployment benefits for workers who lose their jobs. If your Florida LLC has employees, you generally owe this tax and must file a return called the RT-6, according to the Florida Department of Revenue.
The quarterly due dates
RT-6 returns are due four times a year, one per quarter, for any business with employees:
- April 30 — first quarter
- July 31 — second quarter
- October 31 — third quarter
- January 31 — fourth quarter
Who has to file
The rule from the state is simple on paper: if you have employees, you file RT-6 every quarter. The material we have does not say whether an owner with no employees, or an LLC taxed as a sole proprietor with no payroll, is exempt. Check with a Florida CPA or the Department of Revenue if that is your situation.
Employee count also matters for a separate obligation: Florida requires workers' compensation coverage at four or more employees for non-construction businesses, and at one or more employees for construction businesses, according to the Florida CFO's Division of Workers' Compensation. That is a different filing from RT-6, but it depends on the same headcount.
Where to file
Reemployment tax returns are filed with the Florida Department of Revenue, not with Sunbiz or the IRS. The current forms and filing portal are linked from their reemployment tax page. Confirm the portal and any penalty amounts there — the material used for this page does not include a specific late fee for RT-6.
